應該可以設定其中1部,於繁忙時間,只停L3&L6,問題係有人唔想咁做,走票吖!

無睇份屋契,又不是專業人士,成尺厚,点會得閒是颜究呀!

尼處孽萎只會做表面野,唔將其中1部,在繁忙時間,set死只停L3&L6,有電梯知識都知喇!係做唔做啫!其實對我影響不大,但係有人唔想做野!所以出吓聲囉!除非公契寫死,兩部都要開放!開會齋講厨餘,九萬幾次……揾啲新項目講啦!講起部厨餘机,送去小學村,好過放係度!勞民傷財!

Violation of Special Conditions of Grant Clause (53)(a)(i)

Dear sir/madam,

We refer to the captioned grant by private treaty (hereinafter referred to as “the Government Grant”), in which the Grantee is the MTR Corporation Limited (hereinafter referred to as “MTRCL”).

Clause (53)(a)(i) of the Government Grant stipulates the following:

The Grantee (excluding his assigns) shall at his own expense … and thereafter maintain the columns and such other structural supports and connections together with such escalators, lifts, stairways as may be required by the Director … linking the lot to future footbridges (hereinafter referred to as “the Future Footbridges”) in the positions shown and marked “FB2”, “FB3” and “FB4”… (emphasis by the undersigned)

A part copy of the relevant provisions in the Government Grant (Appendix A) is attached herewith for your reference. In essence, the Grantee (i.e. MTRCL) has a contractual liability under the Government Grant to provide maintenance of lifts linking the lot to future footbridges, including FB2, at his own expenses.

However, Clause 8(c)(iii)(1), (2) & (3) in Section E of the Principal Deed of Mutual Covenant (Memorial No. 09062303030203) (hereinafter referred to as “the PDMC”) exclude the aforesaid liabilities from the Grantee and transfer such liabilities to his assigns. A part copy of the relevant clauses of the PDMC and the relevant plan is attached herewith in Appendix B for your reference. As a matter of fact, the maintenance cost of the escalators and lifts as clouded in the plan in Appendix B has been borne by the owners of the residential development erected on Site F of the captioned lot (i.e. the Capitol). The MTRCL, in the capacity of the Manager of the Capitol, has used the management charges collected from the owners of the Capitol to reimburse the cost incurred by the MTRCL to maintain the said escalators and lifts.

In view of the above, we would like to lodge a complaint against the MTRCL for his wrongful deduction from the management charges, collected from the owners of the Capitol, to reimburse the maintenance cost of the said escalators and lifts. We request your office the followings:

1.        To enforce Clause (53)(a)(i) of the Government Grant and demand the MTRCL to maintain the escalators and lifts as clouded in the plan in Appendix B at his own expense;

2.        To demand the MTRCL to rebate the aforesaid wrongful deduction back to the Management Funds of the Capitol.

違反地契特別條款第53項(a)(i)
執事先生/女士:

根據日出康城主公契第E章第8條(c)(iii)(1), (2) 及 (3),位於首都北門兩部連接L2、L3及L6之升降機及電梯,與及近南門連接L1及L3之升降機(如附圖示),其維修保養應由首都小業主承擔,但翻查有關地契,其中特別條款第53項(a)(i)指出受讓人(即港鐵公司),撇除旗下受讓人,有責任全數支付上述升降機及電梯之維修保養費用。有關地契條款請參考附件。

對於港鐵公司沒有遵守上述地契條款,錯誤動用首都管理費用去支付有關升降機及電梯維修保養費用,我們深感不滿。現要求港鐵公司作出以下補救方案:

(一)撥亂反正,港鐵公司全數支付日後有關升降機及電梯之維修保養費用;


(二)退回過往因支付有關升降機及電梯維修保養費用,錯誤從首都管理費扣除之款額。
